By using XuXu, you agree to these terms. Please read them carefully. Our platform connects administrators with community members for transparent and secure contribution management.

1 Acceptance of Terms

By accessing or using XuXu ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to any part of these terms, you may not access or use the Platform.

XuXu provides a digital platform for community-based contribution management, commonly known as "susu" or rotating savings groups. The Platform facilitates the creation of contribution cells, member management, payment tracking, and financial reporting.

2 User Roles and Responsibilities

Administrators

Administrators are individuals who create and manage contribution cells. As an administrator, you:

  • Must complete KYC (Know Your Customer) verification before activating full administrative features
  • Are solely responsible for vetting and approving members who join your cells
  • Bear full responsibility for any misconduct, disputes, or financial irregularities involving members of your cells
  • Must maintain accurate records of all cell activities and member contributions
  • Are obligated to enforce cell rules, including late payment penalties and membership standing
  • Must ensure transparent communication of management fees and deduction policies
  • Agree to cooperate with XuXu in resolving any disputes that may arise

Members

Members are individuals who join cells using a cell code provided by an administrator. As a member, you:

  • May provide optional personal information, but are not required to complete KYC
  • Are responsible for fulfilling contribution obligations according to your cell's schedule
  • Must adhere to the rules and policies established by your cell administrator
  • Acknowledge that the administrator, not XuXu, is responsible for member selection and oversight
  • Agree to resolve any disputes with your cell administrator directly

Note: XuXu verifies administrators, not members. Please exercise due diligence when joining cells.

3 Know Your Customer (KYC) Requirements

To ensure the integrity and security of our platform, all administrators must complete KYC verification. This process requires:

  • Valid government-issued identification (Passport, National ID, Voter's ID, or Driver's License)
  • Full legal name and GH Post Address
  • Upload of ID document for verification

XuXu performs this verification to establish the identity of administrators, as they are the primary point of accountability for cells they create. This verification helps:

  • Prevent fraudulent activities and impersonation
  • Provide a layer of trust for members joining cells
  • Enable dispute resolution and accountability
  • Comply with financial regulations and best practices

Members are not required to complete KYC, as their relationship and trust are with the cell administrator, not directly with XuXu.

4 Administrator Accountability

Full Responsibility Clause

Administrators acknowledge and agree that they are fully responsible and liable for:

  • Member Conduct: Any misconduct, fraud, or illegal activities committed by members of their cells, including but not limited to failure to contribute, misrepresentation, or disputes among members.
  • Financial Losses: Any financial losses incurred by members of their cells, whether due to member default, administrative errors, or other circumstances.
  • Cell Governance: Enforcement of cell rules, including late payment penalties, withdrawal conditions, and membership standing.
  • Dispute Resolution: Resolution of all disputes arising within their cells. XuXu may assist in communication but bears no responsibility for outcomes.
  • Regulatory Compliance: Ensuring their cells comply with applicable local laws and regulations regarding community savings groups.

XuXu's role is to provide the technological infrastructure for contribution management. We do not guarantee the performance, reliability, or trustworthiness of any administrator or member. Administrators are expected to exercise due diligence in selecting cell members and managing cell activities.

5 Member Acknowledgment

By joining a cell on XuXu, members acknowledge and agree that:

  • XuXu verifies administrators only - We confirm the identity of cell administrators through KYC, but do not verify or endorse individual members.
  • Administrators are responsible for member selection - It is the administrator's obligation to vet and approve members joining their cells.
  • Disputes are between members and administrators - XuXu is not a party to any disputes between cell members and administrators.
  • Cell rules are set by administrators - Members agree to abide by the rules, including contribution schedules, penalties, and payout terms established by their cell administrator.
  • No guarantee of returns - XuXu does not guarantee any financial returns or the performance of any cell.

6 Platform Rules and Conduct

All users agree to:

  • Provide accurate and truthful information
  • Not use the platform for any illegal or unauthorized purpose
  • Not harass, abuse, or harm other users
  • Not attempt to bypass platform security or authentication measures
  • Not use the platform to launder money or facilitate financial crimes
  • Comply with all applicable laws and regulations

XuXu reserves the right to suspend or terminate accounts that violate these rules or engage in suspicious activities.

7 Fees and Payments

XuYu deducts a management fee from all contributions processed through the platform. This fee is disclosed to all members before their first contribution. Administrators may set additional cell-specific fees, which must be clearly communicated to members.

All payments are processed through integrated mobile money gateways. XuXu is not responsible for delays or errors caused by third-party payment processors.

8 Limitation of Liability

To the maximum extent permitted by law, XuXu and its affiliates shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Any damages resulting from administrator or member misconduct
  • Any disputes between administrators and members
  • Any financial losses incurred through cell participation

Our total liability to you shall not exceed the total fees paid by you to XuXu in the twelve months preceding the claim.

9 Termination

XuXu may suspend or terminate your access to the Platform at any time, with or without cause, including for violation of these Terms. Upon termination, your right to use the Platform will immediately cease.

Administrators whose accounts are terminated for cause will have their KYC information retained for compliance and fraud prevention purposes.

10 Changes to Terms

XuXu reserves the right to modify these Terms at any time. We will notify users of material changes via email or platform notification. Continued use of the Platform after changes constitutes acceptance of the modified Terms.
